National Immigration Law Center and AFL-CIO Seek To Restore ...

Groups Ask the Second Circuit Court of Appeals to Review National Labor Relations Board Decision

Washington, DC--(ENEWSPF)--March 28, 2012 - The National Immigration Law Center (NILC) and the American Federation of Labor and Congress of Industrial Organizations (AFL-CIO) today asked the U.S. Court of Appeals for the Second Circuit to review a National Labor Relations Board (NLRB) decision denying ?backpay for workers who were fired after complaining about unfair ?working conditions at Mezonos Maven Bakery in Brooklyn, New York.

This legal effort to restore immigrant workers? rights occurs exactly ten years after the Supreme Court decided in Hoffman Plastic Compounds v. NLRB that some wrongfully-fired unauthorized workers are not entitled to back pay under National Labor Relations Act.

"Workers should never have to choose between voicing their concerns about workplace conditions and receiving a paycheck. Unfortunately, that choice was foisted upon the courageous workers at Mezonos Bakery. These workers should not be stripped of legal remedies available to all of us if we are subject to abusive behavior in the workplace," said Marielena Hincapi?, executive director of the National Immigration Law Center. "We're filing this appeal today to fight to protect all workers' basic right to advocate for a fair and safe workplace."?

This is the latest step in a nine year legal challenge to Mezonos Maven Bakery?s firing of the workers.? The five plaintiffs in the lawsuit described horrendous conditions, where workers were forced to work 60 ? 75 hours without receiving overtime and were subject to harassment. Workers were fired by this company after they complained about these conditions.

In the original charge filed with the NLRB, NILC and the AFL-CIO argued that because Mezonos Maven Bakery violated federal law by failing to verify the employees' work authorization when they were hired, the company should not be allowed to escape liability for the wrongful firings based on the Supreme Court?s Hoffman Plastic decision. ?While an NLRB administrative law judge initially agreed that the Hoffman Plastic decision did not apply in this case, the NLRB, relying on Hoffman Plastic, reversed the decision and dismissed the award.?

The NLRB?s ruling gives unscrupulous employers an incentive to hire unauthorized workers, whom they can hire and then illegally fire with impunity, and thereby depress the working conditions of all workers.?

As Ana Avenda?o, the AFL-CIO?s assistant to the president and director of immigration and community action, stated: "If employers can violate the rights of undocumented workers with impunity, all workers suffer. ?Justice demands that all workers be allowed to speak out about unfair or unsafe conditions without fear of being fired for exercising their federally-protected workplace rights."

Researchers have discovered a new way in which computers based on quantum physics could beat the performance of classical computers. The work, by researchers based in Singapore and the UK, implies that a Matrix-like simulation of reality would require less memory on a quantum computer than on a classical computer. It also hints at a way to investigate whether a deeper theory lies beneath quantum theory. The finding is published 27 March in Nature Communications.

The finding emerges from fundamental consideration of how much information is needed to predict the future. Mile Gu, Elisabeth Rieper and Vlatko Vedral at the Centre for Quantum Technologies at the National Univesity of Singapore, with Karoline Wiesner from the University of Bristol, UK, considered the simulation of "stochastic" processes, where there are several possible outcomes to a given procedure, each occurring with a calculable probability. Many phenomena, from stock market movements to the diffusion of gases, can be modelled as stochastic processes.

The details of how to simulate such processes have long occupied researchers. The minimum amount of information required to simulate a given stochastic process is a significant topic of study in the field of complexity theory, where it is known in scientific literature as statistical complexity.

Researchers know how to calculate the amount of information transferred inherently in any stochastic process. Theoretically, this sets the lowest amount of information needed to simulate the process. In reality, however, classical simulations of stochastic processes require more storage than this.

Gu, Wiesner, Rieper and Vedral, who is also affiliated with the University of Oxford, UK, showed that quantum simulators need to store less information than the optimal classical simulators. That is because quantum simulations can encode information about the probabilities in a "superposition", where one quantum bit of information can represent more than one classical bit.

What surprised the researchers is that the quantum simulations are still not as efficient as they could be: they still have to store more information than the process would seem to need.

That suggests quantum theory might not yet be optimized. "What's fascinating to us is that there is still a gap. It makes you think, maybe here's a way of thinking about a theory beyond quantum physics," says Vedral.

LOS ANGELES (AP) ? The feast is on: "The Hunger Games" has taken in $68.25 million domestically in its first day, a record for a non-sequel.

The Friday total for Lionsgate's "The Hunger Games" was the fifth-best opening day ever and puts the movie on track for the best debut weekend ever in March. That record is held by "Alice in Wonderland" with $116.1 million.

First-day revenues for "The Hunger Games" were well behind the record $91.1 million for last summer's "Harry Potter and the Deathly Hallows: Part 2." But "The Hunger Games" came within a few million dollars of each of the last three "Twilight" movies, whose opening days ranged from $68.5 million to $72.7 million.

Doyle's brother gave $100K to pay off URI debt

The brother of the founder of a sports institute under investigation by state police says he contributed $100,000 to settle the nonprofit's debt to the University of Rhode Island.

Michael Doyle said Friday that he had been unaware that the Institute for International Sport owed URI nearly $381,000 for unreimbursed payroll costs and other expenses. He says he made the $100,000 contribution when he learned of the debt.

Doyle is the brother of West Hartford, Conn.-resident Daniel Doyle Jr., who established the institute in 1986.

URI has said the debt was settled. Daniel Doyle has not said what funds were used to pay it off.

The only statement from Doyle's family on the debt was issued on March 2 by RDW Group, Inc., a Providence communications firm where Michael Doyle serves as chairman.

Air Canada says workers returning to work

Air Canada said its groundcrew employees in both Toronto and Montreal were returning to work Friday morning after a wildcat work stoppage that led to dozens of flight delays and cancellations.

Airline spokeswoman Isabelle Arthur told Postmedia News in an email that an arbitrator had issued an injunction, bringing an end to the job action.

Bill Trbovich, spokesman for the International Association of Machinists and Aerospace Workers (IAMAW), said the parties agreed to end the action on the condition the striking workers would not receive any penalties or fines, and the three suspended employees and 37 Air Canada staff that were subsequently fired afterward are reinstated immediately.

At about 10 p.m. local time Thursday, about 150 ground crew workers walked off the job in Toronto. By Friday morning, the labour action had spread to Montreal.

Air Canada employees at the Quebec City airport also went back to work after having walked of the job earlier Friday to support their colleagues.

Quebec City airport authority spokesman said flights were slowly resuming.

No Air Canada flights landed on the Quebec City tarmac nor left the airport between 8 and 10:30 a.m. local time Friday.

The job action came after the federal government moved earlier this month to prevent a work stoppage at the country's biggest airline, passing legislation to block legal strikes or lockouts.

But on Friday, the travel disruptions apparently feared by the government were taking place nonetheless.

Air Canada spokesman Peter Fitzpatrick said Friday that the wildcat action had a "significant impact" on the airline's operations in the affected cities.

"We are doing everything we can to get our operation back to normal," Fitzpatrick said.

"We'll see if the protesting employees respect (the injunction)."

He said Air Canada passengers should check ahead on their status of their flight and said any flights that were cancelled can be re-booked at no cost.

"We really appreciate how important it is to our customers that they get to travel on time when they want to," he said. "This is obviously very frustrating for them."

At least 60 Air Canada flights out of Toronto's Pearson International Airport, and 30 out of Montreal's Pierre Elliott Trudeau, had been cancelled or delayed, according to the airports' websites.

Steve Kent, the chief commissioner of Scouts Canada, said he, his wife and infant son were trying to get to Houston from Newfoundland, but had to turn back after an ordeal that left his family stranded in Toronto overnight.

"Two delays last night, eventually made it to Toronto, sat on runway, then no bags," he said in an email to Postmedia News. "Two hours sleep.

"Found bags downstairs this morning. Houston flight cancelled. Now trying to get back home. Air Canada staff have been very helpful. We may fly at lunchtime, but I'm not optimistic."

Reaction online was less sympathetic to the airline and its workers.

"Slowly but surely Air Canada is sucking the life out of me with each flight I take with them," one person wrote on Twitter, adding the hashtag "aircanadasucks."

Added another user: "Keep it up, unionfolk. You'll destroy your own protection walls eventually."

Peel Regional Police in Ontario got a call about the strike Thursday night and arrived to find about 150 workers gathered at the Pearson airport, said Const. Fiona Thivierge.

The workers were "mostly milling about," she said, noting that it was a peaceful demonstration that had already started to disperse.

"It looks more impromptu than anything else," Thivierge said.

"They're yelling and chanting and stuff, but there are no signs and they're not disrupting the flow, which is what we were most concerned with."

Management was on scene, Thivierge said.

On March 13, legislation passed the House of Commons preventing the airline from locking out pilots and blocking any legal strikes from members of its machinists union. Bill C-33, which passed by a vote of 155-124, addresses about 8,600 mechanics, baggage handlers and other ground crew, along with about 3,000 pilots.

The bill passed the Senate two days later.

Last Sunday, Air Canada said it had asked the government's labour relations board to intervene after an unusually large number of pilots called in sick on a busy spring-break weekend, contributing to numerous flight cancellations.

At that time, Queen's University industrial relations professor George C.B. Smith told Postmedia News the disruptions come as no surprise, given the government's imposition of a resolution.

"There's a huge trust that traditionally exists between employers and employees and when that trust is broken, this is one of the potential outcomes."

Smith, a former director of employee relations for Air Canada, told Postmedia News, "This is the part that (Labour Minister Lisa) Raitt doesn't understand. And this is the part that the Harper government doesn't understand, is that you can superficially get this off the table and you can sweep it away, but there some issues that have to be dealt with. And these employees are not going to accept the way this has been dealt with."

Japanese fishing boat lost at sea in tsunami found off Canada

RENO, Nev. (KRNV & MYNews4.com) - According to King5 in Seattle, a Japanese fishing boat that washed away last March following earthquake and tsunami has been located off the coast of British Columbia.?

The office of Senator Maria Cantwell reports to KING 5 News the 150-foot vessel was located drifting about 120 nautical miles off the Queen Charlotte Islands. The boat was found floating right-side-up.

Japanese officials confirmed the boat was lost after the tsunami.

The National Oceanic and Atmospheric Association is aware of the situation as well.

It is estimated the boat would make landfall in about 50 days, but it will likely be removed by then because it is a hazard to navigation.

This is the first large piece of debris found on the West Coast following the earthquake and tsunami that struck Japan one year ago.

Unintended Consequences of U.S. Immigration Policy

Explaining the Post-1965 Surge from Latin America

March 22, 2012 - A new article by Douglas S. Massey, the Wilson School's Henry G. Bryant Professor of Sociology and Public Affairs, and Karen A. Pren, Project Manager, Mexican Migration Project at Princeton''s Office of Population Research, argues that the post-1965 surge in Mexican, Central American, and to a lesser extent South American immigration was not a direct result of policy reforms enacted in the mid-1960s but rather the unintended consequences that unfolded afterward.

First, prior to 1965 a thriving Bracero Program was in place in which roughly 450,000 persons entered the U.S. from Mexico each year on temporary work visas. These workers returned to Mexico regularly rather than staying in the U.S., thereby creating a circular flow of legal Mexican migrants. The program had a lot of problems, however, so immigration reformers with a civil rights agenda successfully shut it down. But while the program ended in 1965, the business need for this type of labor did not. The result was that Mexican workers continued to enter the country, although now without documentation. Also in 1965, quantitative limits on immigration from the Western Hemisphere were established. Thus illegal immigration rose after 1965 not because there was a surge in Mexican migration, but because these immigration reforms rebranded legal migrants as undocumented workers and capped the number who could try to enter the country legally.

No longer legal guest workers but illegal immigrants, the number apprehended at the U.S.-Mexican border increased. This allowed a new narrative to develop: illegal immigration was a crisis and new policies were desperately needed to stem the flow of the "alien invasion." The more this narrative was repeated by politicians, the more the populace supported increasingly stringent immigration and enforcement policies, setting off a chain reaction: increased apprehensions led to increased calls and better tools for enforcement; increased enforcement led to more apprehensions; and increased apprehensions solidified in the public's mind that illegal immigration was a growing problem that needed drastic reform. Moreover, increased enforcement did not really deter people from entering the U.S. from Mexico, but it certainly encouraged them to stay; the conversion from legal migrant to illegal immigrant was complete.

Second, the U.S. was involved in several Central American countries during the Cold War, which lead to further destabilization in the region and large scale migration north. While Nicaraguan ?migr?s were welcome as refugees (since the U.S. disagreed with the leftist government they were fleeing), others from Salvador, Guatemala, and Honduras encountered the same restrictions for legal entry as Mexicans. After the 1990s, the threat of terrorism intensified border enforcement and brought about a sharp rise in deportations from the U.S. Deportations replaced border apprehensions as "proof" that a Latino threat loomed.

Third, Latin American legal immigration ? led by Mexico -- was also on the rise after 1965, and particularly after 1986. Again, this was not a result of a conscious policy effort, but rather an unintended consequence of the various immigration reforms. Due to concerns about terrorism and a growing xenophobia, Congress began in the 1980s to strip civil, social, and economic rights away from legal immigrants. As it became increasingly problematic to be in the U.S. but not a citizen, the numbers seeking to naturalize increased. This happened just as millions of former undocumented migrants became eligible to naturalize after receiving permanent residence under the Immigration Reform and Control Act (IRCA) of 1986. Adding to the numbers was a separate policy that exempted family members (spouses, minor children and parents) of U.S. citizens from country quotas as part of a family reunification effort.

The authors end the article noting the massive demographic transformation that has resulted from these unintended consequences ? a rise in the Hispanic population from 9.6 million to 50.5 million. They offer a counterfactual scenario, in which the Bracero Program was improved, not abolished, and the U.S. stayed out of Central America; the result might have been a smaller illegal population and a less divided country when the terrorists attacked. More might have continued to cross the border legally and for temporary stays, resulting in fewer permanent immigrants, less undocumented migration, and slower population growth. Amazingly ? almost despite ourselves -- we may actually be headed that way as both illegal and legal entries have fallen while temporary guest worker entry has risen.

The next step is for the U.S. to find a way to deal with the remaining legacy of failed policies ? undocumented residents who number 11 million. Of those, 3 million entered as children. The authors argue that the should receive amnesty ? such as that would have been granted in the Dream Act -- while the adults should be able to participate in an earned legalization program. As the Massey/Pren paper shows, a large number of permanent undocumented people is not a good situation for the country -- and the next policy solution should aim to solve not create more problems.
